PRIVACY POLICY
This Privacy Policy (the Privacy Policy) applies to the processing of personal data by Swiss Peak Experience SA (CHE-396.993.014), c/o CimArk SA, Techno-Pôle 10, 3960 Sierre (SPE) in connection with the Platform accessible at www.swisspeakresorts.com (the Website) and the related mobile application (the App) (the Site and App, collectively the Platform).
By accessing and using the Platform, you expressly agree to SPE processing your personal data in accordance with this Privacy Policy.
SPE reserves the right to amend the Privacy Policy at any time at its sole discretion in order to adapt it to any new commercial or technological practice or change in the law. Should this occur SPE will inform you by any appropriate means (including via email and/or the Platform). If you do not accept the amendments thus made by SPE, your sole remedy is not to use the Platform.
1 introduction
SPE recognizes the importance of your privacy and of transparency in its processing of your personal data.
The Privacy Policy explains (i) which personal data are collected when you access and use the Platform, (ii) the manner and the purposes for which SPE processes the personal data, and (iii) the measures which SPE takes in order to protect them.
2 Data Collection
SPE collects the personal data which you provide.
SPE collects, directly or indirectly via its partners, the personal data you provide in your correspondence with SPE and/or its partners, or in your use of the Platform, for example, when creating and/or managing your account. Such information includes your name, date of birth, gender, address, email, telephone numbers, invoice and/or credit card information, and any other information which SPE and/or its partners may request from you, namely in connection with your stay in a touristic residence of SPE or its partners, including in connection with the persons who share a residence with you.
Certain personal data are also collected in an automated manner.
SPE may also automatically collect personal data when you access and use the Platform, including by means of tools and other active elements contained in the emails of SPE and/or its partners, such as the IP address or other user identifications on your devices, the geolocation of your devices, the data contained in your device, the data contained in third party services (e.g. social plug-ins), the information connected to the services you offer or order via the Platform, your preferences, the internet sites that you visit before and after the Website, the links displayed on the Platform which you select or other information related to your interaction with the Platform, including with the emails sent in connection with the Platform.
You can define certain authorizations and settings related to the automated collection of your personal data.
If you access the Platform via the App, you may define certain authorizations related to data collection, in particular in connection with the geolocation and the App’s right to access data contained in your device, according to the available functionalities. If you access the Platform via the Website, you can define certain settings for the automated collection of your personal data on your web browser. 3 Processing Methods
SPE may process your personal data by automated means, but takes appropriate security measures in this respect.
SPE processes your personal data in compliance with Swiss data protection law and namely takes the appropriate security measures to prevent the unauthorized access, disclosure, modification, or destruction of your personal data. Data processing is carried out with computers or computer tools, and in compliance with the purposes indicated in this Privacy Policy.
4 Purposes of Data Processing
SPE processes your personal data to operate the Platform and to provide the related services.
Your personal data are collected so that SPE may operate the Platform and/or provide the services connected therewith in accordance with the circumstances, or in the manner expressly indicated when the personal data concerned are collected.
SPE may process your personal data for advertising purposes.
SPE may use your personal data, in particular, the contact details as well as other indications and data collected in accordance with this Privacy Policy, for advertising purposes, namely for internal analyses and statistics, to improve its products and services and to send you information and offers relating to the products and services of SPE and/or its partners, such as prospectuses, newsletters, and other advertising messages. You may withdraw your consent at any time.
5 Communication to third parties
SPE may disclose your personal data to third parties in case this is necessary for the proper operation of the Platform and the provision of the related services.
SPE may communicate your personal data to third parties as part of operating the Platform. In particular, if you are a tenant of a touristic residence or a service provider offering its services to tenants of touristic residences via the Platform, SPE may disclose your personal data to its partners as part of the lease of touristic residences and the operation of the Platform. If you are a tenant of a touristic residence, SPE may transfer your personal data to service providers whose services you order via the App. If you are a service provider offering its services via the Platform, SPE may transfer your personal data to the tenants of the touristic residences, which use the Platform.
SPE may also enable you to use third-party services directly from the Platform, namely through social plug-ins, in which case you recognize that the third-party operators of these services may access some of your personal data in connection with the Platform.
You acknowledge and accept that such a disclosure may contain sensitive data.
When operating the Platform, it may be necessary to disclose certain sensitive data to third parties. Therefore, if you are the tenant of a touristic residence and you are interested in activities involving a risk, it may be necessary to disclose certain medical data to the service provider who offers these activities via the Platform. In such case, and if you provide such sensitive data to SPE and/or its partners, you expressly consent to their disclosure to the concerned third parties.
SPE discloses or enables you to disclose your credit card or other information necessary for the management of payments via the Platform to third parties involved in the management of payments, such as SIX, it being noted that SPE does not collect or store this data itself.
SPE may also disclose your personal data to third parties, for promotional purposes.
SPE may use automated marketing solutions to better target its promotional activities and in order to send you more interesting and customized information and advertising via the Internet. In this context, SPE may transfer some of your personal data, in particular the IP address and/or other user identifications for your devices, to the third-party suppliers of these solutions, who will process this data in accordance with their own internal data protection and privacy policies.
6 Disclosure Abroad
Your personal data may be disclosed to countries that do not guarantee the same level of data protection and privacy as Switzerland and the European Union.
SPE stores and handles your personal data in Switzerland and/or within the European Union. But your personal data may be disclosed to other countries, always in compliance with this Privacy Policy, that do not necessarily guarantee the same level of personal data protection as Switzerland and the European Union or an adequate level. If you transfer your personal data to us, you specifically accept such disclosure.
7 Cookies
SPE uses cookies and other similar technologies in connection with the Platform.
SPE uses various types of cookies or other similar technologies some of which are likely to automatically process data directly on your devices and/or to transfer data personal concerning you to SPE.
These technologies are generally aimed at monitoring and analyzing your interactions with the Platform and/or to enable SPE to improve the Platform and its functionalities, namely through a personalization of the Platform and the related services, according to your interactions.
SPE also uses cookies and similar technologies to measure and monitor the traffic and use of the Platform, as well as its performance.
You may manage the cookies and similar technologies via the settings of your browser and/or your devices.
